General Terms and Conditions (GTC)

Important note: The German version of these Terms and Conditions, available at erson.de/agb, is exclusively legally binding. This English translation is provided solely for the convenience of international customers.

§ 1 Provider and Scope

(1) These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between the provider named below and you as a customer via the online shop erson.de.

(2) The version of these GTC valid at the time of order placement shall apply. Any deviating terms of the customer shall not be recognised unless the provider expressly agrees in writing to their validity.

(3) A "consumer" within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity (Section 13 of the German Civil Code – BGB). An "entrepreneur" is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity (Section 14 BGB).

§ 2 Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer but only a non-binding invitation to order.

(2) By clicking the order button ("Order with obligation to pay" or a similar unambiguous wording), the customer submits a binding offer to conclude a purchase contract for the goods in the shopping cart.

(3) The provider will confirm receipt of the order without delay by email. This order receipt confirmation does not yet constitute acceptance of the contractual offer. The purchase contract is only concluded by an explicit order confirmation or by dispatch of the goods.

(4) The contract languages are German and English. In case of any discrepancy between the German and English versions of these GTC, the German version shall prevail.

(5) The contract text is stored by the provider and sent to the customer together with these GTC by email. The GTC are accessible at any time at erson.de/agb where they can be viewed, saved and printed.

§ 3 Prices and Payment Terms

(1) All prices are stated in Euro (EUR) and include statutory value added tax (VAT) and other price components. Shipping costs may be added and will be shown separately during the ordering process.

(2) The following payment methods are available to the customer:

  • Bank transfer (advance payment) to the provider's account – processing of the order begins after receipt of the invoice amount on the provider's account;
  • Payment via PayPal – processing begins after PayPal confirms the payment;
  • Payment via Stripe (credit and debit cards – Visa, Mastercard, American Express; and, where available, additional payment methods supported by Stripe such as Apple Pay, Google Pay, SEPA Direct Debit, Klarna) – processing begins after successful authorisation by Stripe.

(3) When using external payment service providers (PayPal, Stripe), their respective general terms and conditions of use shall additionally apply. The provider does not collect credit card or bank account data; such data is transmitted directly and in encrypted form to the payment service provider.

(4) The customer agrees that invoices and other purchase documents will be transmitted in electronic form (PDF by email).

(5) The delivered goods remain the property of the provider until full payment has been received (retention of title pursuant to Section 449 BGB).

§ 4 Delivery and Shipping

(1) Delivery is made to the delivery address specified by the customer at the time of order. We deliver to the following countries: Germany and other Member States of the European Union.

(2) Delivery time is generally 3 to 7 working days after receipt of payment, unless otherwise stated for the respective product. For custom-made products, delivery time may differ and will be agreed individually with the customer.

(3) The indication of a delivery date is non-binding unless a binding delivery time has been expressly agreed. The delivery period shall be extended appropriately if the buyer delays or fails to provide any required cooperation.

(4) If an order includes goods with different delivery times, the longest delivery time stated shall apply to the entire order, unless partial delivery has been agreed.

(5) Shipping costs will be shown separately during the ordering process and shall be borne by the customer unless otherwise agreed.

§ 5 Right of Withdrawal for Consumers

Withdrawal Instructions

Consumers have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, takes possession of the goods. In the case of an order for several goods within a single order with separate delivery, the period begins on the day on which you, or a third party named by you, takes possession of the last item.

To exercise the right of withdrawal, you must inform us:

by means of a clear declaration (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the model withdrawal form below for this purpose, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse you for all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will use the same means of payment as you used for the original transaction unless expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than fourteen days from the day on which you communicated your withdrawal from this contract to us. The deadline is met if you send the goods before the period of fourteen days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion of the Right of Withdrawal

The right of withdrawal does not apply, in particular, to contracts for the supply of goods that are not pre-fabricated and for the production of which an individual selection or specification by the consumer is decisive, or that are clearly tailored to the personal requirements of the consumer (Section 312g(2)(1) BGB). This applies especially to custom-cut and made-to-measure products in Plexiglas®, PMMA and polycarbonate.

§ 6 Liability for Defects (Warranty)

(1) The statutory provisions on liability for defects apply. The warranty period for consumers is two years from delivery of the goods.

(2) In the case of obvious transport damage, the customer is requested to report this to the delivery service and to inform the provider without delay. Failure to do so does not affect the customer's statutory or contractual warranty claims, but enables the customer to assert their own claims against the carrier.

(3) Any further guarantee is only granted by the provider if expressly stated for the specific product.

§ 7 Liability

(1) The provider is liable without limitation for damages arising from injury to life, body or health resulting from an intentional or negligent breach of duty by the provider, a legal representative or a vicarious agent, as well as for other damages based on an intentional or grossly negligent breach of duty.

(2) The provider is also liable for damages caused by slight negligence to the extent that they result from a breach of essential contractual obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely (cardinal obligations). In such cases, however, liability is limited to the foreseeable damage typical for the contract.

(3) Any further liability of the provider is excluded. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

§ 8 Force Majeure

(1) The parties shall not be liable insofar as they are unable to fulfil their obligations in whole or in part due to an unforeseeable event or force majeure. This includes, in particular: natural disasters, floods, fires, extreme weather conditions, shortages of raw materials, strikes in the transport sector, partial or full strikes or lockouts, government measures, pandemics.

(2) The affected party shall inform the other party without delay, and at the latest within five (5) working days of the occurrence of the event, of the event and its expected effects. The parties shall endeavour to find an amicable solution for the contract performance as soon as possible.

§ 9 Online Dispute Resolution and Consumer Dispute Resolution

(1) The European Commission provides a platform for online dispute resolution (ODR), which is available at https://ec.europa.eu/consumers/odr/. Consumers have the option of using this platform to resolve their disputes. Our email address for these purposes is: info@erson.de.

(2) Note pursuant to Section 36 of the German Consumer Dispute Resolution Act (VSBG): The provider is not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 10 Final Provisions

(1) All contracts between the provider and the customer are governed by the law of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country of their habitual residence (Article 6(2) Rome I Regulation).

(2) All content on the erson.de website, including logos, registered trademarks, texts, photographs, images, drawings, models and graphics, is protected by intellectual property rights. Any use of such content without prior written consent of the rights holder is not permitted.

(3) Should any provision of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by the statutory regulation.

(4) The provider reserves the right to amend these GTC at any time. The version valid at the time of the order shall apply. Changes will be announced on the website.
